JotJokes is a mobile application developed and operated by Pender Production Palace. These Terms constitute a legally binding agreement between you and Pender Production Palace. JotJokes is built using Lovable (lovable.dev), a third-party application development platform, and uses Supabase for secure cloud data storage and sync.
Please read these Terms carefully before downloading or using JotJokes. By accessing or using the app, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the app.

01 Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Pender Production Palace ("Company," "we," "us," or "our"), the developer of the JotJokes mobile application ("App"), governing your access to and use of the App and any related services (collectively, the "Service").
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, do not download or use the App.
02 About the Service
JotJokes is a mobile productivity application developed by Pender Production Palace, designed to help comedians write, organize, track, and develop joke material. The Service is built using Lovable (lovable.dev), a third-party application development platform, and uses Supabase for secure cloud database storage and cross-device sync.
The Service includes the following features, some of which require a paid Pro subscription:

A visual drag-and-drop joke board with customizable columns for organizing material through development stages

Joke card creation with fields for full joke text, premises, tags, categories, ratings, estimated runtime, set placement, color labels, and post-show notes

A Set Builder for organizing jokes into performance setlists with automatic runtime calculation, venue details, and performance notes

An audio recording library for capturing and playing back voice memos attached to joke cards (Pro feature)

Unlimited tags for organizing and categorizing material (Pro feature)

Search and filtering tools for navigating your complete material library

Cross-device sync so your material is accessible on all your devices

Access to all future feature releases included with an active Pro subscription
Pender Production Palace reserves the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes where practicable.
03 Eligibility
You must be at least 13 years of age to use JotJokes. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service. By using the App, you confirm that you meet these eligibility requirements.
The App is not directed to children under the age of 13. If we become aware that a user under 13 has created an account, we will take prompt steps to remove that user's account and associated content.
04 User Accounts & Data
JotJokes requires an account to access the Service. Your account allows your joke content, sets, tags, and audio recordings to sync securely across all your devices. You are responsible for:

Maintaining the confidentiality of your account credentials

All activity that occurs under your account

Notifying us immediately at hello@jotjokes.appif you suspect unauthorized access to your account
Your content is stored in the cloud using Supabase infrastructure, which enables cross-device access. While we take reasonable steps to secure your data, you are responsible for maintaining an active internet connection to sync content. Content created while offline may be stored temporarily on your device and synced when a connection is restored.
Pender Production Palace is not liable for loss of content resulting from account deletion, forgotten credentials, or failure to maintain account access.
05 Subscription & Billing Terms
JotJokes offers both free and paid subscription plans. Certain features of the application are only available through a paid subscription, while the free version includes limited functionality.
Subscriptions are billed on a recurring basis (monthly or annually) depending on the plan selected. Payment will be charged to your Apple account at the time of purchase.
Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Users may manage or cancel their subscriptions at any time through their Apple account settings. Deleting the application does not cancel an active subscription.
Free Trial
JotJokes may offer a free trial period for its paid subscription plans. If a free trial is offered, it will begin upon activation and last for the specified duration (e.g., 30 days).
If the subscription is not canceled before the end of the trial period, it will automatically convert into a paid subscription, and the applicable subscription fee will be charged to your Apple account.
You may cancel your trial at any time before it ends to avoid being charged.
Feature Access
Features available within JotJokes may vary between free and paid plans. Certain functionality, including but not limited to expanded storage, advanced organization tools, and additional features, may only be accessible through a paid subscription.
If a user downgrades from a paid subscription to the free plan, access to certain features may be restricted. However, user-generated content, including jokes, notes, and related materials, will not be deleted and will remain within the user’s account, though some content may become temporarily inaccessible until the subscription is reactivated.
Pricing & Changes
JotJokes reserves the right to modify subscription pricing, features, or plan structures at any time. Any changes will be communicated in accordance with applicable platform requirements.
Continued use of the service after such changes constitutes acceptance of the updated pricing or terms.
06 Your Content
All content you create in JotJokes — including joke titles, full text, premises, tags, categories, ratings, notes, sets, and audio recordings ("Your Content") — is stored securely in the cloud using Supabase infrastructure to enable cross-device access and sync. Your Content is accessible only through your account.
You retain full ownership of Your Content at all times. By using the Service, you grant Pender Production Palace a limited, non-exclusive license to store, process, and transmit Your Content solely for the purpose of providing the Service to you. This license does not permit Pender Production Palace to read, sell, share, license to third parties, or train AI or machine learning models on Your Content.
You represent and warrant that:

You own or have the necessary rights to all content you enter into the App

Your Content does not infringe the intellectual property rights of any third party

Your Content does not violate any applicable laws or regulations
Pender Production Palace does not review Your Content except as necessary to provide the Service, comply with legal obligations, or investigate reported violations of these Terms.
07 Third-Party Platform & Infrastructure
All content you create in JotJokes — including joke titles, full text, premises, tags, categories, ratings, notes, sets, and audio recordings ("Your Content") — is stored securely in the cloud using Supabase infrastructure to enable cross-device access and sync. Your Content is accessible only through your account.
You retain full ownership of Your Content at all times. By using the Service, you grant Pender Production Palace a limited, non-exclusive license to store, process, and transmit Your Content solely for the purpose of providing the Service to you. This license does not permit Pender Production Palace to read, sell, share, license to third parties, or train AI or machine learning models on Your Content.
You represent and warrant that:

The JotJokes application — including its design, user interface, branding, logos, graphics, code, and all content created by Pender Production Palace (excluding Your Content as defined in Section 8) — is owned by Pender Production Palace and is protected by applicable copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.
You may not:

Copy, reproduce, modify, or distribute any part of the App or its content

Reverse engineer, decompile, or disassemble the App

Use the JotJokes name, logo, or branding without prior written permission from Pender Production Palace

Create derivative works based on the App or its code

Sublicense or transfer your rights to use the App to any third party
The JotJokes name and logo are trademarks of Pender Production Palace. Unauthorized use of these marks is strictly prohibited.
08 Intellectual Property
You agree not to use JotJokes for any of the following:

Violating any applicable local, state, national, or international law or regulation

Infringing upon the intellectual property or other rights of any third party
-
Uploading, transmitting, or distributing viruses, malware, or other harmful code
-
Attempting to gain unauthorized access to any part of the App, its infrastructure, or another user's account
-
Scraping, crawling, or otherwise extracting data from the App without Pender Production Palace's written consent
-
Using the App for commercial resale, redistribution, or white-labeling without written consent from Pender Production Palace
-
Circumventing or attempting to circumvent free plan limitations or subscription requirements through technical or other means
-
Interfering with or disrupting the integrity or performance of the Service or its infrastructure
09 Prohibited Uses
10 Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PENDER PRODUCTION PALACE DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. PENDER PRODUCTION PALACE DOES NOT WARRANT THAT ANY DEFECTS WILL BE CORRECTED OR THAT THE APP WILL MEET YOUR SPECIFIC REQUIREMENTS.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not fully apply to you. In such jurisdictions, the disclaimers above apply to the maximum extent permitted by applicable law.
Pender Production Palace is not responsible for any loss of content resulting from service interruptions, data transmission errors, or failures of third-party infrastructure providers including Lovable and Supabase.
11 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PENDER PRODUCTION PALACE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF CONTENT, LOSS OF PROFITS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP OR THE SERVICE, EVEN IF PENDER PRODUCTION PALACE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL PENDER PRODUCTION PALACE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO PENDER PRODUCTION PALACE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) TEN DOLLARS ($10.00 USD).
This limitation of liability applies regardless of the legal theory under which the claim is brought, including contract, tort, negligence, strict liability, or otherwise, even if Pender Production Palace has been advised of the possibility of such damages.
Some jurisdictions do not allow limitations on incidental or consequential damages, so the above limitations may not fully apply to you.
The JotJokes application — including its design, user interface, branding, logos, graphics, code, and all content created by Pender Production Palace (excluding Your Content as defined in Section 8) — is owned by Pender Production Palace and is protected by applicable copyright, trademark, and other intellectual property laws.

12 IIndemnification
13 Termination
Pender Production Palace reserves the right to suspend or terminate your account and access to the App at its sole discretion, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, the Company, third parties, or for any other reason.
You may terminate your account and stop using the App at any time by deleting the App from your device and contacting support@jotjokes.app to request account deletion. If you have an active Pro subscription, you must also cancel it through the App Store as described in Section 7.
Upon termination:

Your license to use the App immediately ceases

Pender Production Palace may delete your account and associated content after a reasonable period, in accordance with our data retention practices

Sections 8, 10, 12, 13, 14, and 16 of these Terms survive termination
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
If you are located outside the United States, you agree that your use of the App is subject to these Terms and all applicable local laws and regulations of your jurisdiction.
14 Governing Law
Pender Production Palace reserves the right to modify these Terms at any time. When we make material changes, we will notify you by:

Updating the "Last updated" date at the top of this page

Displaying a notice within the App on your next session following the change

Sending an in-app notification for significant changes affecting your rights or obligations
Your continued use of the App after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and may request account deletion by contacting support@jotjokes.app.
